1. Provider and Scope
These Terms of Use apply to the Android applications EggQuality and BIT PS, provided by Bröring Technology GmbH (hereinafter referred to as the “Provider”).
The applications are designed to collect, display, store, and process measurement data in combination with compatible measuring equipment supplied by the Provider.
The EggQuality application is intended for use with compatible equipment for measuring and evaluating egg quality parameters. The BIT PS application is intended for collecting and processing measurement data from compatible poultry weighing systems.
The applications are primarily intended for commercial and professional users.
2. Free Provision of the Applications
Both applications are provided free of charge through the Google Play Store. The Provider does not charge any license or usage fees for downloading or using the applications. The applications do not contain paid in-app purchases.
Compatible measuring equipment is required for their intended use and may be purchased separately.
3. Requirements and Intended Use
The applications are intended exclusively for use with the designated compatible measuring equipment. Full or intended functionality is not possible without the corresponding equipment.
Users are responsible for operating the applications and connected measuring equipment in accordance with the applicable operating instructions.
The applications must not be used for unlawful purposes.
4. Data Storage and Export
Measurement data collected by the applications is stored locally on the Android device used.
The applications allow users to export and share stored measurement data, for example by email. Such exports are initiated exclusively by the user. Measurement data is not automatically transmitted to servers operated by Bröring Technology GmbH.
Users are responsible for selecting recipients, sharing exported data, and regularly backing up their measurement data. When exporting data by email, the privacy policies of the respective email service providers also apply.

5. Availability and Technical Requirements
The applications are designed for supported Android devices and compatible measuring equipment.
The Provider endeavors to ensure reliable functionality and may release updates to improve security, stability, and compatibility. Compatibility with all Android devices, operating system versions, or future Android updates cannot be guaranteed.
Certain functions may depend on the technical capabilities of the Android device and connected measuring equipment.
6. License and Intellectual Property Rights
The Provider grants users a non-exclusive, non-transferable right to use the applications for their intended purposes.
The applications and their components are protected by copyright and other applicable intellectual property laws. All rights to the software remain with the Provider or the respective rights holders.
Any use permitted by mandatory applicable copyright laws remains unaffected.
7. Responsibility for Measurement Data
The applications support the collection and processing of measurement data from connected equipment.
The quality and reliability of measurement results depend, among other factors, on proper operation, the technical condition of the equipment, and calibration where applicable.
Users are responsible for operating the equipment under the intended conditions and regularly backing up important measurement data.
8. Liability and Warranty
The Provider’s liability is governed by applicable statutory provisions.
Liability for damages caused intentionally or through gross negligence, as well as for injury to life, body, or health, remains unlimited.
In cases of slight negligence involving the breach of essential contractual obligations, liability is limited, to the extent permitted by law, to foreseeable damages typical for the contract.
Mandatory statutory liability provisions remain unaffected. Statutory warranty rights and any applicable warranty claims relating to purchased measuring equipment remain unaffected by these Terms of Use.
9. Updates and Changes
The Provider may release application updates, particularly to improve functionality, security, or compatibility.
Changes to these Terms of Use will be made in accordance with applicable legal requirements. The current version will be published on the Provider’s website.
10. Privacy
Information regarding the processing of personal data in connection with the applications is provided in the Provider’s Privacy Policy. These Terms of Use do not replace the Privacy Policy.
11. Governing Law
These Terms of Use are governed by German law, without prejudice to mandatory consumer protection provisions.
